Hello and welcome to Sylth Virago!  We are a sustainable footwear company dedicated to ethical and kind practices, as well as to protecting and respecting the privacy of our users.  This Privacy Policy describes how we collect, use, and share information in connection with our Website, www.sylthvirago.com (the “Site”).  It also explains your rights and choices with respect to such information.

Please read this Privacy Policy carefully and let us know if you have any questions.  By visiting or using the Site or otherwise providing information to Sylth Virago, you are consenting to the collection, use, and sharing of your information as described in this Privacy Policy.  This Privacy Policy is incorporated by reference in the Sylth Virago Terms of Service, which govern your use of the Site.

Information that We Collect

Personal information means any information that you provide to us which personally identifies you, or other data that can be reasonably associated with or linked to such information by Sylth Virago. We and our service providers collect a variety of personal information through the Site and by other means, including:

  • Information you submit when you make a purchase.  We collect information when you make a purchase on our Site.  This may include your name, shipping and/or billing addresses, email address, orders you initiate, as well as your Sylth Virago username and password if you choose to create an account. Sylth Virago does not collect your payment information when you make a purchase; this information is collected and processed by a third-party payment processor, Shopify.
  • Information you submit when you contact us.  We collect information when you send us an email, call us, use the chat function on our Site, or submit information through the contact form on our Site.  This may include your name, email address, phone number, and the content of your communication.
  • Information we collect when you browse the Site.  We and our service providers automatically receive and record certain information when you use our Site.  For example, this may include your device’s IP address, information about your use of the Site during your current session and over time (including the pages and products you view and your interactions with them), the date and time of your visit, links you click, searches conducted, the Site visited before navigating to our website, social media referrals used to find the Site (such as Facebook and LinkedIn), your software and hardware attributes (including browser and operating system type and version), and your general location inferred from IP address.  To obtain such information, we or our service providers may use the following technologies to recognize your device and collect information about your usage of the Site:
  • Server logs.  When you use the Site, we automatically receive and record certain information from your computer (or other device) and your browser.  To obtain such information, we may use server logs or applications that recognize your device and gather information about its online activity.
      • Cookies.  The Site uses “cookies,” which are small text files that are stored on your computer that retain your information, activities, and/or preferences relative to your activities on a Site.  Should you wish to prevent your computer from accepting cookies from the Site, you can change the settings on your web browser to either block cookies sent from the Site, or to disable cookies altogether.  Please note that the Site may not function properly, or may function differently, if you choose not to receive cookies.
      • Web beacons.  The Site or the emails that you receive from Sylth Virago may use an application known as a “web beacon” (also known as a “clear gif” or “pixel tag”).  A web beacon is an electronic file that usually consists of a single-pixel image. It can be embedded in a web page or in an email to transmit information, which could include personal information.  For example, it allows an email sender to determine whether a user has opened a particular email. If you would like to opt out of Sylth Virago’s use of web beacons in promotional emails, please opt out of receiving such messages by using the “unsubscribe” link at the bottom of any such message.
    • Information acquired from third parties.  We may supplement the information we receive from you with other information acquired from third parties.  This may include general demographic information, such as gender and income information, or inferences about your interests.

    We may combine information collected through the Site with information that we collect in other contexts, such as information from email communications with you or third parties.  We will treat such combined information in accordance with this Privacy Policy.

    How We Use Information that We Collect

    We and our service providers use the information that we collect for a variety of purposes, including:

    • Providing our services to you.  To provide our services to you, complete transactions that you initiate and fulfill orders, and for other purposes related to providing our services.
    • Communicating with you.  To send you information about our services and other topics that are likely to be of interest to you, including newsletters, updates, or other communications; communicate with you in response to your inquiries; and deliver confirmations, account information, notifications, and similar operational communications.
    • To improve user experience and the quality of the services.  To count and recognize visitors to the Site, analyze how visitors use the Site and Site features, improve the Site, create new products and services, and conduct analytics, including as described in the section below titled “Third-Party Advertising and Analytics.”
    • To tailor our content, advertisements, and offers.  This may include the use of third-party tools to send advertisements, as described in the section below titled “Third-Party Advertising and Analytics.”
    • Legal purposes.  For legal or other necessary purposes, including as described below in the section titled “How We Share information.”

    We also use your information to generate aggregated or de-identified data that does not identify clients or individuals.  This aggregated or de-identified data is used for our own business purposes as well as for other purposes consistent with applicable laws.

    How We Share Information

    We share information with third parties for a variety of reasons, including as follows:

      • Service providers.  We use service providers to help us manage and improve our Site.  These service providers may collect and use your information to assist us in achieving the purposes discussed in this Privacy Policy.  For example, we may use third parties to send emails on our behalf, operate the chat functionality on our site, perform data storage and processing services, and perform analytics, including as described in the section below tiled “Third-Party Advertising and Analytics.”  Please note that, by accessing the Site and using our services, you consent to the transfer of personal information to these service providers.
      • Payment processing.  We use a third-party payment processor, Shopify, to process payments on our behalf.  
      • Third-party plugins.  The Site may integrate certain third-party plugins (such as Facebook, Instagram, and Pinterest plugins).  Even if you do not click on these plugins, they may collect information about you, such as your IP address and the pages that you view.  They also may set and/or access a cookie or use similar tracking technologies. These plugins are governed by the privacy policy of the company providing them.
      • Legal purposes.  We may use or share information with third parties when we believe, in our sole reasonable discretion, that doing so is necessary:
    • To comply with applicable law or a court order, subpoena, or other legal process; 
    • To investigate, prevent, or take action regarding illegal or prohibited activities, suspected fraud, violations of our rules or terms and conditions, or situations involving threats to other individuals, our property, or the property or physical safety of any person or third party; or
    • To establish, protect, or exercise our legal rights or defend against legal claims.
        • Organizational transfers.  We may share your information with third parties to facilitate the financing, securitization, insuring, sale, assignment, bankruptcy, or other disposal of all or part of our organization or assets.
        • Aggregated and de-identified information.  We may share aggregated and de-identified information with third parties, such as by sharing reports with third parties about trends in the usage of the Site.

        Please note that, by accessing the Site and using our services, you consent to the transfer of personal information to our service providers, including Shopify.

        Third-Party Advertising and Analytics

        When you access our Site and use our services, we may serve you advertisements regarding goods and services that may be of interest to you (or in some cases, to users whom our service providers deem to have characteristics or interests similar to our customers) based on information relating to your access to and use of the Site and services and other websites.  To do so, we or our service providers may use cookies, web beacons, pixel tags, and similar technologies to collect personally identifiable information about your online activities over time and across different websites.         We also partner with certain third parties to collect information to engage in analytics.  These third parties may use server logs, web beacons, tags, pixels, mobile device identifiers, and similar technologies, and they may set and access cookies on your computer or other device.  We use the information collected through these technologies to analyze page views, purchases made, conversions, and information about your shopping cart and browsing habits.         Like many other online services, the Site does not respond to “do not track” browser signals with respect to such sharing with third parties.

        Third-Party Links and Sites

        The Site may be linked to third party Sites or contain information provided by third parties. Sylth Virago does not make any representation as to the accuracy or completeness of such Sites or information, has not and will not review or update such Sites or information, and cautions users that any use made of such Sites or information is at their own risk. Sylth Virago disclaims any and all warranties, express or implied, to any such linked sites, including but not limited to any terms as to the accuracy, ownership, validity or legality of any content of a linked Site. By using the Site, you expressly relieve Sylth Virago from any and all liability arising from your use of any third-party Site.

        Data Security

        Sylth Virago uses commercially reasonable security measures, including physical, technical, and administrative safeguards to protect your information against loss or unauthorized access, use, modification, or deletion.  However, no security program is 100% secure, and thus we cannot guarantee the absolute security of your information.

        Your Rights and Choices

        If you no longer want to receive our newsletters or other promotional communications, please follow the “unsubscribe” instructions that are included at the bottom of each such message.  Please note that if you unsubscribe from our promotional communications, you may still receive administrative messages from us.

        You may modify the name and address associated with your account by accessing your account settings.  If you would like to request that we delete your information, please send us an email at concierge@sylthvirago.com.

        Children’s Privacy

        The Site is not intended for nor directed to children under 13, and Sylth Virago will not knowingly collect personal information from anyone under the age of 13.  We request that children under 13 do not provide information to us through the Site.

        Changes to This Privacy Policy  

        We may revise this Privacy Policy periodically in the future.  If we make any material changes that affect data we have previously collected, we will post the revised Privacy Policy on our Site, with an effective date indicating when the revised Privacy Policy will take effect.  We encourage you to review this Privacy Policy periodically.
